Terms of Service.

These Terms govern access to and use of GARGATE, including AI model access, QRIS payments, Payment ID based result retrieval, uploaded content, generated outputs, and operational limitations.

1. Acceptance of Terms

By accessing or using GARGATE, users agree to these Terms of Service. If a user does not agree with these Terms, the user must not create payments, submit AI requests, upload media, or use the result retrieval features.

GARGATE is operated as a no-login AI gateway by BSTN Innovation Studio. The service provides access to AI models and local QRIS payment flows through a web interface.

2. Service Flow

Users select a model, provide required inputs, calculate pricing, create a QRIS payment, complete payment, and wait for the AI task to be submitted and processed. Generated results are displayed through a Payment ID or process page.

The backend validates inputs, recalculates pricing before payment creation, submits AI tasks only after payment confirmation, and updates status through verified webhooks or recovery checks.

3. Payment Terms

Payments are processed through BSTN Payment Gateway using Dynamic QRIS. The payable amount may include base amount, admin fee, and unique code. Users must pay exactly according to the amount shown on the payment page.

Expired, canceled, failed, denied, reversed, refunded, chargeback, or otherwise unsuccessful payments will not be processed as completed AI requests. Users may need to create a new transaction if the payment window expires.

4. Pricing and Model Availability

AI model pricing, availability, schemas, output formats, and processing behavior may change based on upstream providers. GARGATE recalculates pricing server-side before creating a payment to reduce the risk of stale or incorrect pricing.

We may add, remove, disable, reorganize, or update models at any time without prior notice where required by provider changes, technical stability, legal obligations, or operational requirements.

5. Payment ID and Result Access

Because GARGATE does not require accounts, the Payment ID or process identifier functions as the primary access key for checking status and retrieving generated results. Users must store this identifier securely.

Anyone with access to the Payment ID may be able to view the associated status and output. GARGATE is not responsible for unauthorized access caused by users sharing or exposing their Payment ID.

6. User Content and Permissions

Users are solely responsible for prompts, uploaded files, reference images, audio, video, text, configuration values, and other materials submitted to the service. Users must have all necessary rights, licenses, and permissions for submitted content.

Users must not upload or generate content that is illegal, abusive, exploitative, defamatory, privacy-invasive, infringing, harmful, deceptive, or otherwise prohibited by applicable laws or upstream AI provider policies.

Uploaded media may be transferred to the selected AI provider or required media infrastructure. Once transferred, the provider's own policies, safety systems, technical capacity, and processing limitations may apply. Users must not submit confidential, sensitive, or third-party materials unless they have the right and authority to do so.

7. User Rights and Output Ownership

GARGATE does not claim ownership over user prompts, uploaded media, or generated outputs. Subject to applicable law and upstream provider policies, submitted content and outputs belong to the user.

Users are responsible for reviewing outputs, preserving important results, and determining whether outputs are suitable for publication, commercial use, legal use, or any other purpose.

8. AI Output Disclaimer

AI outputs are generated by third-party models and may be inaccurate, unexpected, incomplete, offensive, unsuitable, or inconsistent with user expectations. Users are responsible for reviewing outputs before using, publishing, or relying on them.

GARGATE does not guarantee a specific creative result, commercial suitability, legal clearance, uniqueness, ranking outcome, or uninterrupted provider availability.

9. Retention and Result Availability

Uploaded media is intended to be deleted within 30 days. Generated output media is also intended to be deleted within 30 days. Users should download or save important outputs promptly because long-term hosting is not guaranteed.

Some operational records, including payment status, webhook events, hashed security signals, audit timestamps, and error metadata, may be retained longer for reconciliation, security, dispute handling, debugging, abuse prevention, or legal compliance.

10. Refunds and Failed Processing

Payment completion does not guarantee that an upstream AI provider will always return a successful output. Failures may occur due to invalid inputs, provider errors, moderation rules, downtime, network problems, or unsupported request combinations.

Refund handling, if available, is assessed case by case through official support channels and may depend on payment gateway status, upstream usage, provider response, transaction evidence, and operational feasibility.

11. Data Handling and No Sale

GARGATE does not sell, rent, or disclose user data to unrelated parties for advertising, profiling, resale, or data brokerage. Data is used only as needed to operate the service, process AI requests, manage QRIS payments, secure the platform, support users, investigate abuse, and comply with lawful obligations.

Technical data stored by GARGATE is used for service operation, reliability, payment reconciliation, fraud prevention, and security. All user-submitted materials and generated outputs remain the user's materials to the extent permitted by law and provider terms.

12. Prohibited Use

Users must not attempt to abuse, overload, scrape, reverse engineer, bypass payment, bypass Turnstile verification, tamper with webhooks, exploit bugs, access other users' Payment IDs, or interfere with service infrastructure.

We reserve the right to block requests, reject transactions, restrict access, remove outputs, or preserve audit records when abuse, fraud, security risk, or legal risk is suspected.

13. Limitation of Liability

The service is provided on an as-available and as-is basis. To the maximum extent permitted by law, GARGATE and BSTN Innovation Studio are not liable for indirect losses, lost profits, failed creative outcomes, provider downtime, user misuse, or third-party service disruptions.

Users are responsible for saving generated outputs, preserving Payment IDs, verifying payment status, and ensuring that their use of outputs complies with applicable laws and third-party rights.

14. Changes to These Terms

We may update these Terms to reflect product changes, legal requirements, provider policies, payment rules, or operational improvements. Continued use of the service after changes means the user accepts the updated Terms.
